Rep. LaMonica McIver (D-10) is back in federal court in Newark today, where her attorney is asking for all charges against her to be dismissed.
She pleaded not guilty in June to federal charges accusing her of assaulting and interfering with immigration officers outside Delaney Hall detention center in Newark during a congressional oversight visit at the facility.
She was indicted on three counts of assaulting, resisting, impeding and interfering with federal officials. Two of the counts carry a maximum sentence of up to eight years in prison. The third is a misdemeanor with a maximum punishment of one year in prison.

McIver says she's the victim of "vindictive and selective prosecution." She claims she's been targeted and bullied by President Trump and U.S. Attorney for New Jersey Alina Habba since the incident.
While McIver is inside the courtroom, a protest is planned outside in support of her. Immigration rights groups and local leaders are calling for the charges to be dropped.
The charges were filed after McIver joined other members of Congress in May for a surprise inspection at Delaney Hall. During the visit, she confronted federal agents about her right to be there and the arrest of Newark Mayor Ras Baraka.
At the time of the arrest, Habba said, "While people are free to express their views for or against particular policies, they must not do so in a manner that endangers law enforcement and the communities those officers serve."
