U.S. Rep. LaMonica McIver is petitioning a federal appeals court to reconsider dismissing assault charges against her following a clash with law enforcement outside Delaney Hall last year.
Attorneys for the New Jersey congresswoman filed a petition asking the full U.S. Court of Appeals for the Third Circuit to review her case. The move comes after a panel of judges on the federal court previously refused to throw out the charges against her earlier this year.
McIver was charged with simple assault in connection with an altercation with law enforcement officers outside the Delaney Hall detention facility in Newark.
Despite the initial appellate setback, McIver's legal team is seeking a rehearing en banc before the entire Third Circuit bench, arguing the charges against the sitting lawmaker should be dismissed.
