A former Wayne middle school principal, acquitted of charges that he groped a teen, is now suing state police.
Frank Mobilio used to be the principal at George Washington Middle School. In 2003, a 13-year-old Sussex County girl accused Mobilio of groping her after a Jets game. Mobilio, a father of three, was suspended without pay after the alleged incident.
In October of 2006, Mobilio was acquitted of all the charges. He said one of the main reasons he is now suing state police is because they withheld results of a DNA test on the girl?s jeans. Those results had turned up negative for Mobilio?s DNA.
?It wasn?t until a couple of years into this whole thing that we learned that the state police actually had the results of the DNA test the day before I was arrested,? Mobilio said. ?They did not share that information with the judge who signed the arrest warrant nor did they share it with my attorney for well over a year and a half.?
Mobilio?s suit also claims a detective coerced a witness and that a false affidavit was filed for his arrest.
Meanwhile, after the acquittal and an investigation by the Wayne Board of Education, the board reinstated Mobilio in the district as the director of secondary education.
