A federal judge has ruled a lawsuit against actor Jussie Smollett will not be dismissed, and the case can proceed in Chicago.
The suit asks Smollett to reimburse the police department $130,000 spent on investigating his alleged attack.
Smollett alleges he was the victim of a racist and homophobic hate crime attack back in January.
The actor was charged will filing a false report, but those charges were dropped.
Smollett maintains his innocence.
A special prosecutor could still charge him with staging the attack.
