Residents who live along Bay Beach Way received approval from the state appellate court Thursday to leave Toms River and become part of Lavallette.
Residents say their street had been ignored by Toms River officials after a 2003 blizzard, when it took three days for the town to plow the street. Some residents formed the Bay Beach Way Realignment Committee to petition the state to make the road part of Lavallette.
The street borders Lavallette and many residents say they already consider themselves part of that town over Toms River. The Toms River City Council will decide if the case should be heard by the state Supreme Court.
