A grand jury had decided to indict a Paterson police officer accused of firing his weapon and striking two people with bullet fragments outside a 7-Eleven earlier this year.
Dante Gordon, 26, was off-duty during the February shooting on the 200 block of Main Street.
Employees at the store previously told News 12 New Jersey that Gordon and the victims were arguing before the shooting.
Investigators are trying to determine why Gordon fired his weapon.
Gordon was suspended without pay from the Paterson police force and was ordered to wear an electronic bracelet.
He could face up to 10 years in prison if he is convicted of the charges.
