The retrial of former Nets star Jayson Williams was debated in the state?s Supreme Court Monday.
Williams? lawyers and the state are arguing over what evidence should be allowed in his retrial on reckless manslaughter charges in the death of his driver, Gus Christofi. Williams? lawyers say the new trial date can?t be set until it is decided whether a new jury will be able to hear what Williams did directly after Christofi was shot.
The evidence in question was introduced at the first trial, but the state appellate panel ruled it inadmissible for the retrial. Prosecutors say the evidence is essential for the jury to hear, however Williams? defense attorney says what happened after the incident doesn?t shed light or give more information.
Williams was charged in 2002 in the shooting death of Christofi. He was found not guilty of aggravated manslaughter in 2004, but was found guilty on several counts of tampering. The jury was unable to reach a verdict on the reckless manslaughter charge.
