A Jersey City police officer surrendered Monday to Hudson County authorities after he allegedly drove drunk, leading to a toddler's death.
Police Officer Kevin Freibott was initially charged with driving while intoxicated and assault by auto after getting into an accident January 23 on Pulaski Skyway while he was off duty. Ruth Zelaya and her 2-year-old son, Jose Carlos Zelaya, who were passengers in the car Freibott allegedly hit, were injured in the crash. A charge of aggravated manslaughter was filed against Freibott Sunday after Jose Carlos died from his injuries. The child?s mother remains in critical condition at Jersey City Medical Center.
Authorities say test results show Freibott's blood alcohol content was three times above the legal limit. A preliminary investigation also found he was driving more than 30 miles over the speed limit. Records show the officer, who is related to the mayor of Jersey City, transferred to his current department after racking up a lengthy disciplinary history at another department.
Freibott was released on $350,000 bail. The police force suspended Freibott without pay after the incident. If convicted of manslaughter, he could face up to 30 years in prison.
