The state attorney general is now handling a case from last month in Middletown where a marked police car struck and killed an e-bike rider.
Officer Tim Funk, of Atlantic Highlands, was making a right turn on red when the crash happened, according to the attorney general.
Henry Phillips, 73, died at the scene. The state has not said if Funk was answering a call as investigators continue to work the case.
