Sen. Shirley Turner (D) is working on legislation that would prohibit people deemed criminally insane and incarcerated in psychiatric hospitals for certain crimes from voting.

Turner was inspired to write the bill after learning that 41 inmates, who were jailed for crimes like mass murder, rape and pedophilia, had submitted absentee ballots for Tuesday?s election. Some votes were discarded.

Turner says she is especially angry to know that those convicted and deemed criminally insane had a say in the election, while many law-abiding residents were turned away from the polls for questions about their eligibility.

?If you are not competent enough to stand trial, then I don't see how you could be competent enough to vote,? Turner says.

Turner hopes to have her bill introduced by the end of the month. Currently under a Court of Appeals ruling, people in psychiatric hospitals are allowed to vote until proven incompetent.
