Prosecutor: Newark sergeant charged in the death of traffic officer had BAC of .11%

The off-duty Newark sergeant charged in the crash was legally drunk, according to court documents.

New information this morning concerning the tragic death of Newark Police Officer Jairo Rodriguez, who was struck and killed while on traffic duty.
The off-duty Newark sergeant charged in the crash was legally drunk, according to court documents.
Rodrigues was on traffic duty at the intersection of Lafayette and Broad streets following a concert at the Prudential Center last month.
The Affidavit of Probable Cause shows the blood sample taken from Sgt. Victor Ortiz showed he had a blood alcohol content of .114, which is over the legal limit.
It also shows that Ortiz was apparently at a local bar prior to the incident and prior to the bar was at a holiday party.
When he allegedly struck the 53-year-old officer, the Jeep Ortiz was driving was doing 54 mph in a 25 mph zone, according to the affidavit.
