Rodrigues was on traffic duty at the intersection of Lafayette and Broad streets following a concert at the Prudential Center last month.
The Affidavit of Probable Cause shows the blood sample taken from Sgt. Victor Ortiz showed he had a blood alcohol content of .114, which is over the legal limit.
It also shows that Ortiz was apparently at a local bar prior to the incident and prior to the bar was at a holiday party.
When he allegedly struck the 53-year-old officer, the Jeep Ortiz was driving was doing 54 mph in a 25 mph zone, according to the affidavit.
