A federal judge has denied a motion to dismiss one of the counts in Congresswoman LaMonica McIver's indictment following an incident outside a Newark immigration jail last May.
McIver is accused of assaulting and interfering with federal officers during the incident, which was caught on video.
The judge ruled that legislative immunity does not apply in this case.
McIver said she was disappointed with the ruling and added that it is her responsibility to visit detention facilities like Delaney Hall.
