Morris County prosecutor Robert Bianchi is fighting to bring illegal immigrants accused of crimes to trial and prevent them from getting an easy out through deportation.
Bianch wants higher bail for serious offenses so he can keep the accused in jail -- instead of turning them over to Immigration authorities. He says immigrants accused of crimes like murder and sexual assault are taking the easy way out by opting to leave the country.
"It is a virtual guarantee that if they're an illegal, what they can do is consent to deportation and it's a get out of jail free card," he says.
Bianchi recently tried to get a higher bail to keep a suspect behind bars and lost. He's appealing that case to the Supreme Court, hoping things will change if he wins.
"Something needs to be done so that we'll have the opportunity to be able to give our victims their day in court," he says.
