A 14-year-old who was shot by police after they said he pointed a gun at them during a foot chase in Trenton will not be tried as an adult.
A spokesman told the Times of Trenton the attorney general's office would not to seek to waive the case out of juvenile court.
The boy is charged with aggravated assault and gun crimes.
Police and witnesses said the boy pointed a .22-caliber handgun at two state troopers and a Mercer County sheriff's officer who began to chase him on Aug. 7.
Investigators said the gun was found the following morning under the tire of an emergency response vehicle near where the teen was running.
The teen was released from a hospital and his lawyer said he expected him to be exonerated.
