Rep. LaMonica McIver has filed an appeal to dismiss charges against her following her arrest in May outside Delaney Hall – a Newark immigration detainee facility.
The Democratic congresswoman is accused of assaulting and interfering with immigration officers. McIver’s attorneys have argued that the charges are selective and vindictive. They say she has legislative immunity.
A federal judge denied most of the motions, but one count is pending.
"This appeal is for everyone who is standing up to [the Trump] administration as they try to operate without oversight, silence the people who oppose them, and shut down those who protect the vulnerable,” McIver wrote in a statement.
McIver returned to Delaney Hall last week for an oversight visit in the wake of the death of a detainee.
