A lawsuit filed Monday by the borough of Paramus is targeting American Dream and several retail stores in the complex for operating on Sundays.
The suit claims the mall is violating Bergen County’s Blue Laws, which date back to the 1700s and only allow essential businesses to operate on Sundays.
The lawsuit names mall operator Ameream, Bergen County, East Rutherford, and the New Jersey Sports and Exposition Authority as codefendants.
Paramus Mayor Chris DiPiazza said in a statement that American Dream is breaking its promise to follow the Blue Laws, adding that retailers in the borough have long competed on a fair playing field.
The New Jersey Business and Industry Association is backing the mall, saying businesses should be free to choose when to open and close.
Mall representatives argue that because the property sits on state-owned land, it is exempt from the Blue Laws, similar to MetLife Stadium.
