A Manville man paralyzed from the neck down is fighting his local police department to receive a gun permit for hunting.
James Cap, 44, was paralyzed during a high school football game in 1979. He says he considers himself an outdoorsman and wants to start hunting again. However, he says the Manville Police Department won?t grant him a gun permit.
Cap says he spent thousands of dollars on a mechanism that will allow him to use his cheek to maneuver and fire a shotgun. He also says he has his hunting license.
The police department says it is just following state police guidelines, which require someone to be able to transport, load, unload and fire a gun in order to obtain a permit.
In a statement, the department stated, ?[Cap] just does not fit the criteria and we do not have the power to set conditions. Only a superior court can do that.?
The department could make a decision on Cap?s permit as soon as Monday. If the department denies the permit, Cap?s lawyer plans to appeal in a superior court.
