DiFiore is accused of placing his hands around the child's neck and applying pressure, causing them to experience difficulty breathing, fear and physical pain, according to court documents. Court records say the child was less than 17 years old.

News 12 was told this all unfolded at a teenager's birthday party.

Police have not said what happened in the moments leading up to the alleged incident.

DiFiore is due back in court Thursday morning. His attorney told News 12 that he can't comment on the case.
