The Forest Hill Community Association is suing PSE&G and Newark employees because of the installation of high voltage lines.
Residents in Newark say they have major concern over the 60,000 volt lines set to be installed in the city's historic district.
On Aug. 15, homeowners noticed poles being place in the area. The community association's attorney, George Sommers, says they filed a lawsuit that same day.
Sommers alleges that PSE&G has not gotten the proper approvals to do the work. He says the company did not go before the Board of Public Utilities and the Landmarks and Historic Preservation Commission.
In a statement provided to News 12, PSE&G said in part: "PSE&G is upgrading the electric system throughout the state to provide safe, reliable service....In advance of the overhead construction activities, PSE&G has communicated with affected customers and received the necessary approvals to work in the area."
Sommers say that the construction will cause health concerns and that the company never got an exemption in whole or part from the Board of Public Utilities.
Homeowners plan to continue to protest on Monday in front of the federal courthouse.
News 12 reached out to the city of Newark, but have not heard back yet. PSE&G says safety is a top priority.
