The parents of a Seton Hall University student filed a wrongful death lawsuit against the school citing negligence and failing to monitor their daughter.
Kristen McCartney died in September 2021 after she tested positive for COVID-19 and entered mandatory isolation. The lawsuit alleges McCartney died alone in an isolated dorm room after suffering a seizure from a rare form of epilepsy.
The woman’s parents say school officials were aware of her seizure disorder and failed to check on her.
A staff member discovered McCartney face down on the floor. The lawsuit alleges she suffered a grand mal seizure, which may have caused her to bite her tongue and suffocate in her blankets.
The parents say it took the university several hours to notify them about the incident.
A spokesperson for Seton Hall issued a statement denying any wrongdoing.
“Kristen was a beloved member of our community. We continue to mourn her passing, which was heartbreaking, but not the result of any actions by the University,” the spokesperson stated.
