The widows of hockey stars Johnny and Matthew Gaudreau are suing the driver charged in their husbands’ deaths. The wives are claiming negligence and recklessness.

Sean Higgins is accused of driving drunk and striking the brothers while they rode bicycles in southern New Jersey in August. The brothers were in New Jersey to celebrate their sister’s wedding the next day.

Police say Higgins had a blood alcohol level of .087, which is above the state’s legal limit of .08.

Higgins’ legal team earlier this month tried to get the case dismissed by arguing that the brothers were drinking prior to the crash.

Johnny Gaudreau was a professional hockey player for the NHL’s Columbus Blue Jackets.
