Lawsuit: Family says plexiglass windows allowed 2-year-old to fall to his death from high-rise apartment

The lawsuit claims that the windows were made of plexiglass and poorly secured to the building.

The family of a 2-year-old who died after falling 20 stories from a high-rise apartment complex in Newark, filed a lawsuit against the owner of the building.

The lawsuit claims that the windows were made of plexiglass and poorly secured to the building.

The incident happened at 7 a.m. on a Saturday in November when a window made of plexiglass within Elizabeth Towers came loose, allowing the 2-year-old to fall to the ground.

Attorney David Sirotkin filed the suit for the family.

“The windows were put on as thin plexiglass that was glued onto the outside of the window frame. And why did the building do this? There’s only one reason, it was to save money,” said Sirotkin.

Their lawsuit states that the boy’s mother had complained to building employees in the past that the windows weren’t safe.

“Her windows in the past had come literally flying off the window frame to the ground below. And what would the building do? They’d come back up and glue another piece of plexiglass back on,” said Sirotkin.

The lawsuit also references the lack of window guards.

They are required by law in New Jersey when there are children under the age of 10 living within a unit.

So far, the management team with Elizabeth Towers has not spoken about the boy’s death or the windows.

The Essex County Prosecutor’s Office is also investigating this death. That office will determine if criminal charges should be applied to this case.
