? The defense attorney for a Duke lacrosse player from Essex Fells continued his assault on the prosecution?s rape case in papers filed last week.
Reade Seligmann, 22, is one of three players indicted on charges of rape and kidnapping during a team party in North Carolina in March. Kirk Osborn laid out his argument in a 30-page motion. He claims Durham police intentionally omitted information that paved the way for a photo lineup and approval for players? DNA samples. Osborn also says a second dancer told police the allegation was a lie because she was with the accuser at the party, except for five minutes. Documents also show the accuser told officers she performed for a couple hours before using a sex toy, which Osborn believes could be the source of injuries found in a rape exam. The defense also takes issues with one of the examiners, who was in training.
District Attorney Mike Nifong has not responded to the motion, but has previously said he intends to bring the case to trial.
