Approximately 20,000 individuals convicted of drunk driving between 2008 and 2016 may be eligible for post-conviction relief, following a revelation by the New Jersey Attorney General's Office.

The issue stems from the improper calibration of breathalyzer tests by former state police Sgt. Marc Dennis. His failure to maintain the accuracy of these devices has led to the inadmissibility of those test results in court.

Dennis was sentenced to five years in prison in 2023 for tampering with the breathalyzer equipment. With this development, those affected by the flawed tests are now entitled to challenge their convictions.
