A U.S. appeals court in Philadelphia has lifted a stay in the case of "Real Housewives of New Jersey" husband Joe Giudice, laying the foundation for his removal to Italy, the country where he was born.
Giudice's attorney says he will continue to fight to return to the U.S.
He could be sent to Italy by the end of the month.
Giuidice, 47, was ordered to be deported to his native country of Italy back in October of 2018, and has been behind bars since November of 2016 after getting sentenced for tax evasion.
He was released from prison and into ICE custody this March, as a judge has yet to rule his fate.
Giudice and his wife, Teresa, 47, pleaded guilty in 2014 to financial fraud. Giudice is an Italian citizen who was brought to the U.S. as a baby and says he wasn't aware he wasn't an American citizen.
Teresa Giudice served nearly a year in prison and was freed in December 2015.
The couple has four daughters together.
