A judge ruled Thursday that she does not have the authority to declare a winner of the 120th state House District race in Stratford.

Superior Court Judge Barbara Bellis granted a motion for an emergency injunction until the House can determine if Rep. Phil Young or his Republican challenger Jim Feehan won the election.

The secretary of the state cannot certify a winner even though Thursday was the deadline to do so.

The Connecticut House of Representatives would now need to request a special election.

Young's attorney says that the Connecticut constitution requires the House to determine the case while Feehan's attorney thinks that the courts should be responsible for holding the new election.

Feehan said he will appeal the decision to the state Supreme Court, saying the voters in Stratford should determine who their representative is and not politicians in Hartford.
