Judge declares mistrial in stray-bullet killing of 12-year-old Genesis Rincon
A Paterson judge has declared a mistrial in the case involving a 12-year-old girl killed by a stray bullet in 2014.
Jurors in the murder trial of Genesis Rincon told the judge Thursday that they were deadlocked, but were ordered to keep working.
The jurors also asked the judge if they could deliver a verdict on one or more of the defendants while not reaching a unanimous agreement on the others. Three men were on trial for the murder. The judge ruled that they could.
Rincon was shot and killed by a stray bullet on July 5, 2015 while she was riding her scooter near her home.
Jhymiere Moore and Jeffrey Ellerbee are accused of firing the shots in the neighborhood where Rincon lived. Marshae Anthony is accused of providing the guns used in the shooting.
Officials did not immediately say if or when this case would go back to trial.
