Kearny rally condemns shooting of man during ICE arrest

A rally was held in Kearny Sunday to condemn the shooting of a man by Immigration and Customs Enforcement officers after he allegedly intervened in a recent arrest of his stepfather.

Protesters gathered outside the Hudson County Jail where the stepfather, Gaspar Avendaño Hernandez, was arrested is now being detained.

His 26-year-old stepson, Erick Diaz, was shot by ICE officers Thursday as he allegedly tried stopped them from taking Hernandez into custody.

Activists alleged that the men resisted complying with the officers because the officers didn't identify themselves or display any documentation or badges to show they were law enforcement.

They said that Diaz was unarmed, and accused the agency of holding his stepfather so he would be unable to testify against them.

ICE says two of its officers were assaulted by the Diaz right before the shooting.

They also say Hernandez had been removed from the U.S. twice before, and has a 2011 conviction for assault.

Diaz was shot in the face but survived.
