A couple from Norwood is distraught and outraged after their son's killer received probation and community service for the crime -- ruled as a misdemeanor with no jail time.
Douglas Guido, 22, of Hasbrouck Heights, walked out of Orangeburg Town Court Wednesday with three years probation and 60 days of community service for fatally punching R.J. Hess, 21, outside of a bar in Pearl River back in July 2018.
Guido's attorney, Nancy Lucianna, says the boys were actually friends, but it was a night that got out of hand.
Lucianna says on the night of June 23, 2018, the boys, including the victim, got drunk at the Pearl River Saloon -- so drunk that Hess had a blood alcohol level of .337.
Lucianna showed News 12 surveillance photos, saying Hess wouldn't stop shoving Guido until he finally.

"Mr. Guido threw one punch to ward him off and unfortunately Mr. Hess dropped to the ground and suffered a very severe injury," says Lucianna

News 12 is told Hess died in the hospital within 48 hours of the punch, but the official cause of his death is unknown.
Ill will or not, the Hess family says this sentence is not justifiable.

"You're held accountable when someone dies, even if it's one punch or two punches, we have to be held accountable,” says Hess family attorney Kevin Conway.

The judge said in determining the final sentencing, he took into account the boys' lifelong friendship and that Guido had no criminal history.
