Judge gives green light for construction of controversial Hamilton mall
(02/22/05) HAMILTON ? A judge?s ruling has paved the way for the construction of a large shopping mall in Hamilton, despite efforts by town officials to nix the project altogether.
Although the Hamilton Planning Board shot down plans for the mall?s construction in May, a judge has sided with developers after the decision was appealed. Hamilton residents and officials are now asking the mall?s developers, Levin Management, to make some changes to the structure for the safety of nearby schoolchildren.
Some residents say a number of the mall?s planned entrances on Klockner Avenue are too close to an elementary school. Concerned parents would like the entrances changed from Klockner Avenue to Route 33, which they say is a commercial business strip.
Officials at Levin Management responded to the entrance requests by saying, ?Our site plan designers were sensitive to the proximity of the school and we believe sincerely that our design takes the safety of the children into consideration.?
