Tracy Morgan released from rehab facility; suing Wal-Mart over fatal NJ Turnpike crash
EDISON - Tracy Morgan is suing Wal-Mart for negligence after a fatal crash last month on the New Jersey Turnpike.
A Wal-Mart tractor-trailer crashed into Morgan's limousine bus, injuring him and three others, and killed his fellow comedian and mentor, James McNair, also known as Jimmy Mack, on June 7.
The lawsuit alleges that Wal-Mart should have known the driver, Kevin Roper, had been awake for more than 24 hours before the crash. A preliminary investigation by the National Transportation Safety Board also revealed that Roper was speeding prior to the collision.

Roper pleaded not guilty to death by auto, among other charges.
Morgan was released from a rehabilitation facility Saturday as he continues his recovery.
