NJ court rejects recall of US Sen. Menendez

TRENTON - (AP) - New Jersey's Supreme Court says a tea-partygroup can't continue with its effort to recall U.S. Sen. RobertMenendez.

In a 4-2 vote, the court on Thursday shot down the argument fromlawyers for the Committee to Recall Robert Menendez. The group saidit's up to states to regulate recall efforts because the U.S.Constitution is silent on the issue.

Judges sided with lawyers for the New Jersey Democrat, who saida recall would violate the U.S. Constitution. Menendez is up for re-election in 2012.

His critics wanted him ousted early because, among other things,Menendez voted in favor of the health insurance overhaul.

The recall committee says it will be appeal to the U.S. SupremeCourt.
