NEW BRUNSWICK - The driver of a Wal-Mart truck charged in the fatal New Jersey Turnpike crash that also injured comedian Tracy Morgan and several others pleaded not guilty during a court appearance Wednesday.

Kevin Roper, 35, appeared in state court in New Brunswick to face charges including death by auto and assault by auto. The judge kept his bail at $50,000.

Roper is accused of having gone without sleep for 24 hours when he allegedly swerved to avoid slowed traffic and crashed into the limo carrying Morgan and six others early Saturday.

Morgan, 45, is in critical but stable condition at Robert Wood Johnson University Hospital. He suffered broken ribs and underwent surgery for a broken leg. Fellow comedian James McNair was killed, and two other passengers were seriously injured.

"Jimmy Mack," as he was known, was close friend of Morgan's. His funeral will be held Thursday in Peekskill, New York.
