NEW BRUNSWICK - The truck driver accused in the Tracy Morgan Turnpike crash officially pleaded not guilty.
Kevin Roper was working for Walmart at the time.
An NTSB investigation found he was speeding and had worked 13 hours straight when he crashed into Morgan's limo, injuring Morgan and killing his friend, comedian James McNair.
Roper's lawyer is working to get aggravated manslaughter and other charges dismissed due to pretrial publicity and Walmart's civil settlement with Morgan.
"It'll be a serious effort to have this indictment dismissed,” says attorney David Glassman. “And this will stop the criminal prosecution in its tracks. We wouldn't be filing it if we weren't optimistic that it had merit."
The defense has one month to file paperwork.
